The pigeons have come home to roost of Chesley Rafferty, of Domain Names Australia/America infamy. Rafferty sent out countless letters which looked like invoices to domain name holders, telling them that their registration was about to expire and asked for hundreds of dollars to renew them.

Nobody knows exactly how much money Rafferty made from the scam, but some reckon it’s millions. The Commerce Commission alone stopped over $500,000 worth of credit card transactions going into a Swiss bank account in Rafferty and fellow slammer Bradley Norrish’s names. The pair also raided the Nominet whois database for .uk, and hit British domain name holders with a mass mailout from Internet Registry UK, asking them for £175 fees.

Whereas our Commerce Commission didn’t take legal action against Rafferty, the Australian Competition and Consumer Commission did, and also the Australian Domain Administration, which manages the .au namespace. They went after Rafferty in 2002 and last year, the Australian Federal Court found Rafferty guilty of breaching the Trade Practices Act, and ordered him to pay costs to the ACCC and auDA.

Both the ACCC and auDA petioned for Paul Chesley Rafferty, 26, to be made bankrupt, but it seems he beat them to it and fell on his own sword instead. Norrish meanwhile seems to be busy still through his Internet Registrations Worldwide company that has registered around 2,000 .us domains. He is also involved in a premium-rate SMS scheme whereby people are lured into entering a competition to win a plasma TV if they sign up for a horoscope service at A$2.50 per message.

Incidentally, Rafferty is not a friend of the FryUp. It appears he took umbrage to us describing him as a “scammer”. He was “embarrassed” for the FryUp that we didn’t bother to find out any factual detail and he threatened to sue unless we printed a retraction, as those without leg to stand on sometimes do. Mr Rafferty is also a director of a company called Internet Registrations Worldwide Pty Ltd which has its registered office at the same address in Perth as Diverse Internet. He succeeded Mr Norrish as a director of Internet Registrations Worldwide on 27 January 2003.

Bradley Norrish alleges errors on this web site

Bradley Norrish sent me an email during the week alleging various errors on this web site and
requesting that I take down the web site and send him an apology to the DNS list.

Here is the email I wrote in response:

Regarding your email with the subject line “whatsinaname misleading information” sent to me on 16 March, 2004 you allege that the www.whatsinaname.com.au/slammers/ web site contains “an extraordinary number of errors” which are “false, slanderous and misleading information” and make various demands.

The information on the web site is of public interest. I do not intend to take down the web site or apologise to you.

Thank you for pointing out the alleged errors on the web site. I would appreciate you letting me know if you believe there are any other alleged errors on the web site.

I have taken care, and have carefully verified information on the web site. While the information provided on the web site is considered to be true and correct at the date of publication, changes in circumstances after the time of publication may impact on the accuracy of the information. If you are aware of any changes to the information then I invite you to let me know.

With regards to the six alleged errors you specified in your email:

1. The email addresses jason@di.com.au is “non existent” – I received an email with the subject line “Error on your drawing” from Mr Jason Namour on 3 March 2004 admitting to the use of this email address. Multiple posts to the “DNS list” from Mr Namour are also from this email address.

Gregg Moscoe posted an email to the Neustar policy forum mailing list on 3 June 2003 which alleges your association with iregistrations.com. The domain name bradleynorrish.com is registered through iregistrations.com and has name servers of ns1.registrations.com.au and ns2.registrations.com.au; you are the registrant for registrations.com.au. a. If this news article is incorrect then your issue is with the publisher of ComputerWorld. Please notify me if you are able to have the news article changed and I will update my diagram accordingly. I also note that you seem to have good understanding of the management structure of Domain Names NZ, a subsidiary of Domain Names Australia run by Chesley Rafferty.

Domain Names Australia Pty Ltd nets $2.3M (Chesley Rafferty)

The 500,000 allegedly misleading advertisements by Domain Names Australia Pty Ltd (Chesley Rafferty) was the biggest issue in the domain name market to affect consumers in 2003 according to auDA CEO Chris Disspain – ZDNet news article.

Neustar promised to take action against an offender, an Australian company with nearly 2,000 domains they’re holding for resale. They allowed the offender to simply change the “inaccurate information” in their application to appear to comply with Nexus requirements. The argument offered by Neustar is that the people in question had a company incorporated in the U.S. which was qualified at the time of the registration. They were just stupid and didn’t follow directions. Now that’s all been cleaned up and everything is fine. Wrong.

The domain I was originally seeking was pointed to a holding page, then to a domain services company in Australia, and now to… nothing. But I bet it’s still for sale for $1500, which is what they demanded from me. When you figure they pay $6-$10 a domain. Buy 2,000 domains at $6 each for $12,000. Sell 10 at $1500 each, you’re ahead. Sell 100 @$1500, you’re way ahead. That’s profiteering at our expense.

The first problem with this position is that Neustar’s and/or eNom’s systems should have flagged these applications and never accepted them in the first place.
