DDNS picks up IRA domain name (Bradley Norrish)

Discount Domain Name Services, an auDA Accredited Registrar, has registered Internet Registrations Australia’s old domain name “registrations.com.au”.

The www.registrations.com.au web site currently says:

IMCO Corporation suspends Ezinames web site (Bradley Norrish)

It appears that Bradley Norrish’s IMCO Corporation has suspended Bradley Norrish’s Ezinames web site. Ezinames is the trading name for Internet Registrations Australia Pty Ltd.

Users attempting to access the Ezinames web site (http://www.ezinames.com/) are redirected to an IMCO Corporation Pty Ltd web page (http://server.imcoserv.com/suspended.page/) which says:

Ezinames not using Westpac merchant services (Bradley Norrish)

Regarding my complaint to a number of authorities about Ezinames (trading as Internet Registrations Australia Pty Ltd).

Westpac Banking Corporation (WBC) has written to domainwatch.org to confirm that they

“do not provide merchant services to either Internet Registrations Australia Pty Ltd or Domain Names Australia Pty Ltd.”

More Ezinames spam (Bradley Norrish + Craig Oehlers)

Reports are coming in about more spam from Ezinames aka “Domain Name News · 1800 Century Park East · Los Angeles, CA 90025″

A google search shows the abundance of these paricular spams:

Craig Oehlers’ surname appears on some of the image URLs in the spam – http://www.a1info.net/images2/oehlers/9604/register_ad2.jpg

Since Ezinames is operated by an Australian Company – Internet Registrations Australia Pty Ltd (Bradley Norrish) – they may have breached the Australian Spam Act Cth (2003).

Good Morning,

I am writing to report the misleading and deceptive conduct of Ezinames; an Australian domain name registration company.

The scam is described in detail here: http://domainwatch.org/archives/2004/12/27/unsatisfied-ezinames-customer-bradley-norrish/ and is briefly summarised as follows:

  1. The user registers a .com domain name for $US 5.95 per annum, paying by credit card
  2. The package includes a 7 day free web hosting trial (normally $US 599 per annum)
  3. You are told that you can log onto their web control panel and opt out of the trial
  4. When the above is attempted a signed form must be faxed to a New York number
  5. Failure to do the above results in the $US 599 web hosting charge on your credit card

I have not been misled myself, however I am aware of countless others who have been and I wish to lodge this complaint on their behalf.

I maintain a consumer information web site – http://domainwatch.org/ – which has been recording the activities of this company and others who have questionable marketing practices. Information specific to Ezinames is available here: http://domainwatch.org/archives/category/ezinames/

Ezinames previous name was iRegistrations (http://domainwatch.org/archives/category/iregistrations/) which uses very similar tactics to those above.

According to the terms and conditions on their web site (http://www.ezinames.com/index.php?act=other&feat=terms), Ezinames is the trading name for Internet Registrations Australia Pty Ltd (ACN 096 256 110) which, according to ASIC, is a deregistered company and is operated by Bradley Norrish of East Perth.

The terms and conditions also refer to Westpac Banking Corporation, which I assume provide merchant facilities for Ezinames.

WESTPAC DOES NOT PROVIDE MERCHANT SERVICES FOR EZINAMES

Westpac Banking Corporation (WBC) has written to domainwatch.org to confirm that they “do not provide merchant services to either Internet Registrations Australia Pty Ltd or Domain Names Australia Pty Ltd.”

Internet Registrations Australia Pty Ltd is known to the ACCC and has permanent injunctions from engaging in false or misleading representations regarding registration and renewal of Internet domain names (http://www.accc.gov.au/content/index.phtml/itemId/331708).

It is also come to my attention that Ezinames is using spam to market its services; http://domainwatch.org/archives/2004/12/12/ezinames-domainenewscom-spam-bradley-norrish/

Ezinames’ web hosting trial is now for only 3 days, not 7 as stated above.

The terms and conditions below imply that you can opt out of the free web hosting trial via their online control panel. The fact that you need to send a signed fax to New York to opt out of the 3 day free web hosting trial, or else you get slugged $599 is not stated at all. This, in my opinion, is misleading and deceptive.

2.6 Additional Services

2.6.2 Currently each new ezinames account attracts the provision of the following services for the first domain registered from ezinames : Bulk 500MB Hosting account, host up to 20 domains with up to 20,000MB data transfer (20GB), 500x POP email accounts, 20 MySQL Databases, 200 FTP accounts, 200 Mailing Lists, 500 Sub-domains, CGI-Bin, Control Panel, Search engine submission (provided in hosting control panel).

2.6.4 ezinames offers these services free for a trial period of 3 days from the date of domain name registration.

2.6.5 Registrant can cancel these services for any reason during the initial free 3 day trial period without incurring any charge other than that for the domain registration.

2.6.6 Cancellation of Web Hosting can be done by logging into the account and selecting the ‘Cancel Service’ button in the ‘Web Hosting’ area.

2.6.7 Registrant can cancel these services at any time by logging into the account with the associated username and password. Cancellation within the free 3 day trial period incurs no service charges beyond the domain registration.

2.6.8 Non-cancellation within this allocated period constitutes acceptance by the registrant for the continuation of and subsequent billing at the standard rate for these services. Services are provided and billed for on a yearly basis. If services are cancelled during the year service period no pro rata refund of the remainder of the year is available.

2.6.9 Billing after the initial free trial period is by direct debit from the registrants nominated credit card at the rate of $US595 for 1 year service period. This charge will be billed in $AU at the then current exchange rate as provided at www.x-rates.com

2.6.11 Should ezinames receive an RFI (Request For Information) from the credit card processor regarding any charge to the registrants nominated credit card (including but not limited to fees for domain registration, hosting, or search engine submission) then ezinames shall immediately gain full ownership, control and possession of the domain name involved. The domain may be returned when the matter is resolved to the satisfaction of both parties. The registrant will also be liable to pay ezinames an RFI administrative fee of $US30.00.

2.6.12 Should ezinames receive an RFI (Request For Information) from the credit card processor regarding any charge to the registrants nominated credit card (including but not limited to fees for domain registration, hosting, or search engine submission) then the registrant will be required to sign and return all necessary transaction acceptance documentation requested by ezinames by fax to ezinames within 48 hours of ezinames sending this documentation by email, sending being defined as when it leaves ezinames servers not when the customer reads the email.

2.6.13 Should any fees charged by ezinames to the registrants nominated credit card for the account be charged back (including but not limited to fees for domain registration, hosting, or search engine submission) then ezinames shall gain full ownership, control and possession of the domain name involved. The registrant will also be liable to pay ezinames a chargeback administrative fee of $30.00.
