Nominet has succeeded in obtaining injunctions against three Australian companies and one individual for their parts in a data mining attack on the Nominet register and for issuing misleading registration documents.

The court will pass judgement on the activities of a fifth defendant, Bradley Norrish, and will take orders for damages and costs at a later date.

Nominet obtained the injunctions from the Federal Court of Australia against Chesley Rafferty, Diverse Internet Pty Ltd, Internet Payments Pty Ltd and (UK) Internet Registry Ltd. The cases were settled after the parties admitted copyright theft by extracting millions of records from Nominet’s WHOIS Internet domain name database.

“We’re delighted by progress so far on this case and have a very positive outlook for the overall result,” said Lesley Cowley, Managing Director at Nominet. “Naturally, we want to protect the information that we hold as a domain registry and to be successful in proving copyright ownership is a significant success for us. Similarly, the welfare and security of .uk registrants is paramount and by fighting, and winning, against these fraudsters we are saying very clearly that scamming is an issue we take seriously and want to see brought to justice.”

In late 2002, employees of Diverse Internet Ltd and Internet Payments Ltd attempted to copy Nominet’s register of domain names by abusing the company’s WHOIS service (a database of information on domain name users). Nominet detected these attacks and was forced to take the unprecedented step of suspending the WHOIS service for the only time in its six-year history.

The aim of the attack was to capture address details of .uk domain name registrants and resulted in many hundreds of registrants receiving fraudulent invoices from a company called UK Internet Registry.

Diverse Internet Ltd and Internet Payments Ltd were under the control of Mr Norrish and Mr Rafferty, and employees of these companies.

Legal proceedings commence this week against Bradley Norrish and UK Internet Registry for copyright infringement and breach of Australian fair trade laws by issuing misleading invoices. During the hearings, Nominet presented papers and computer hard disk drives seized by the Federal Court, which contain evidence that domain registrants’ information was illegally obtained.

Bradley Norrish alleges errors on this web site

Bradley Norrish sent me an email during the week alleging various errors on this web site and
requesting that I take down the web site and send him an apology to the DNS list.

Here is the email I wrote in response:

Regarding your email with the subject line “whatsinaname misleading information” sent to me on 16 March, 2004 you allege that the www.whatsinaname.com.au/slammers/ web site contains “an extraordinary number of errors” which are “false, slanderous and misleading information” and make various demands.

The information on the web site is of public interest. I do not intend to take down the web site or apologise to you.

Thank you for pointing out the alleged errors on the web site. I would appreciate you letting me know if you believe there are any other alleged errors on the web site.

I have taken care, and have carefully verified information on the web site. While the information provided on the web site is considered to be true and correct at the date of publication, changes in circumstances after the time of publication may impact on the accuracy of the information. If you are aware of any changes to the information then I invite you to let me know.

With regards to the six alleged errors you specified in your email:

1. The email addresses jason@di.com.au is “non existent” - I received an email with the subject line “Error on your drawing” from Mr Jason Namour on 3 March 2004 admitting to the use of this email address. Multiple posts to the “DNS list” from Mr Namour are also from this email address.

a. Please confirm that this email address is no longer active and then I will independently verify this information. Once verified I will update the diagram from “di.com.au -> provides email address:
jason@di.com.au -> Jason ‘Magz’ Namour” to read “di.com.au -> provided email address: jason@di.com.au -> Jason ‘Magz’ Namour”

2. The email addresses wy@di.com.au is “non existent” - This email address was listed in the AUNIC database under “NIC” handles WY48-AU and WY50-AU which were both created in June 2001.

a. Please confirm that this email address is no longer active and then I will independently verify this information. Once verified I will update the diagram from “di.com.au -> provides email address:
wy@di.com.au -> Wilson Young” to read “di.com.au -> provided email address: wy@di.com.au -> Wilson Young”.

3. “I am not associated with registrations.com” - The web site makes no mention of registrations.com. If however you meant to refer to iregistrations.com then I can provide the following information: the
registrant for the domain name iregistrations.com is Internet Registrations Worldwide Pty Ltd - Peter Jacobs. Chesley Rafferty is the director of Internet Registrations Worldwide Pty Ltd. Gregg Moscoe posted an email to the Neustar policy forum mailing list on 3 June 2003 which alleges your association with iregistrations.com. The domain name bradleynorrish.com is registered through iregistrations.com and has name servers of ns1.registrations.com.au and ns2.registrations.com.au; you are the registrant for registrations.com.au. The domain name contact details for iregistrations.com lists “Level 2, 297 Hay St, East Perth WA 6004″ which is also common with the registration address for irww.com; you are the registrant for irww.com. The previous registrant for irww.com was Peter Jacobs who is the current registrant for iregistrations.com. The domain name irww.com.au is registered to Internet Registrations Worldwide Pty Ltd with yourself as the registrant contact.

4. “Alex Restovski is no longer a director of Diverse Internet” - The web site makes no mention of Alex Restovski.

a. If however you meant to refer to Alex Ristovski then please confirm that is the case and then I will independently verify this information. Once verified I will update the diagram from “Alexander Ristovski -> Director of -> Diverse Internet Pty Ltd” to read “Alexander Ristovski -> ex-Director of -> Diverse Internet Pty Ltd”.

5. “Paul Fox is not general manager of Domain Names NZ and never was” - The web site refers to a ComputerWorld news article titled “Commissioner wades in over DomainNamesNZ” by Paul Brislen on 31 October 2002, the author makes reference to ” DomainNamesNZ … general manager Paul Fox … “.

a. If this news article is incorrect then your issue is with the publisher of ComputerWorld. Please notify me if you are able to have the news article changed and I will update my diagram accordingly. I also note that you seem to have good understanding of the management structure of Domain Names NZ, a subsidiary of Domain Names Australia run by Chesley Rafferty.

6. “irww.com address incorrect” - This allegation is unclear, which irww.com address do you refer to? The two addresses on the diagram are: “Level 2, 297 Hay St, East Perth WA 6004″ and “1040 Avenue of the Americas New York, NY 10018 USA”

a. Please provide the new address and then I will independently verify this information.
