Chesley Rafferty’s Domains Australia Pty Ltd – his latest domain name registration company – has sent out a new batch of marketing notices:

In my opinion these marketing notices may be difficult for an ordinary person to distinguish from a real invoice for an existing service (their domain name) which requires payment by a certain date.

One of Chesley Raffery’s previous companies, Domain Names Australia Pty Ltd, was found guilty of misleading and deceptive conduct for similar activities by an Australian Federal Court.

Even though an Australian Federal Court found Domain Names Australia Pty Ltd (Chesley Rafferty) guilty of misleading and deceptive conduct, the company is still causing problems for domain name buyers.

Well, I’ve just had a call from an outraged client.

They originally got caught by one of Chesley’s look-alike dot-com domain scams in August 2004. In December that same year my client received a $187 renewal notice, which their accounts department recently paid in ignorance.

Let’s look at what Chesley’s done, and is still up to, through Domain Names Australia …

1. The original registration was as a result of a deceptive and misleading mailer, and was in fact unwanted;
2. The mailer promised a 2-year registration period, among other “services”. On investigation whois reports that the original registration was for only a 1-year period, despite 2 having been paid for;
3. The “renewal notice” was sent out less than 4 months after the original unwanted domain name was registered by Domain Names Australia (with enom);
4. The services that were promised on both the original mailer and the renewal notice have never been provided;
5. Some of the registrant information is false, in that registrant contact details are actually those of Domain Names Australia;

I’ve tried to get some response from enom on previous occasions, and it’s a complete waste of time. If, for example, there is a domain name that Chesley has registered, that the registrant actually wants (yes – there are some!), the only password that is available is Chesley’s master reseller password, so transfers to another registrar are not possible. This is particularly frustrated by the fact that registrant contact details refer back to Domain Names Australia, even the phone and fax numbers.

Mr Rafferty is also a director of a company called Internet Registrations Worldwide Pty Ltd which has its registered office at the same address in Perth as Diverse Internet. He succeeded Mr Norrish as a director of Internet Registrations Worldwide on 27 January 2003.

auDA Consumer Alert: Federal Bureau of Domain Names

auDA warns Australian businesses to be wary of American domain name organisation

.au Domain Administration (auDA), the administrator of .au domain names, today issued a warning to all Australian businesses with domain names, and those likely to register domain names in the future, to be wary of an organisation trading as Federal Bureau of Domain Names (FBODN), http://www.fbodn.com.

auDA has been informed that FBODN has contacted several Australian businesses – including an internationally renowned Australian icon – falsely positioning itself as the global domain name administrator.

auDA understands that FBODN has told these Australian businesses that someone has applied to register their name in .biz but that FBODN has blocked the registration and is now able to offer the name in .biz to the Australian business.

Chris Disspain CEO of auDA said, “As far as auDA can ascertain, FBODN is not an official, or US Government-endorsed, administrator of .biz or any other domain name extension. As such, Australian businesses should be wary of any contact with FBODN.”

“Australian businesses should also be aware that anyone can register a .biz domain name. Additionally, those who own the comparable .com domain name extension are not able to veto the registration of the .biz extension by someone else.” Mr Disspain continued.

Despite FBODN’s website being heavily branded with American icons, imagery and references to the US Federal Government, www. fbodn.com is registered to Michael Goodall – a resident of London, England.

“At this stage auDA and its international domain name administrator counterparts are still investigating FBODN. However, I stress again that all Australian businesses who are contacted by FBODN should act cautiously” Mr Disspain concluded.
